This notice outlines the steps for submitting a valid takedown request, as well as the procedure for users to respond via a counter-notification if they believe the takedown was in error.

When a DMCA takedown notice is received and determined to be complete, we will act quickly to remove or disable access to the specified content. We also notify the user responsible for uploading the content and provide them with information on how to respond. This process ensures that the rights of both parties are fairly addressed.

Under the DMCA, we are required to forward the contents of a valid takedown notice—including the copyright owner’s name and contact information—to the individual who posted the allegedly infringing content. This is necessary to allow them to submit a legal counter-notice if appropriate.

How to File a Valid DMCA Takedown Notice

To submit a DMCA takedown notice, your request must include the following required elements. Notices missing any of these elements may not be processed:

• A detailed description of the copyrighted work that you claim has been infringed. For multiple works, you may include a representative list.
• Identification of the specific material that is claimed to be infringing, including its exact location on our platform (such as direct URLs or other identifiers).
• Your full legal name and contact information, including your mailing address, phone number, and email address.
• A statement declaring that you have a good faith belief that the material is being used without permission from the copyright owner or the law.
• A statement made under penalty of perjury affirming that the information in the notice is accurate and that you are authorized to act on behalf of the copyright holder.
• Your electronic or physical signature, completing the submission.

Once your notice has been verified, we will promptly take down or disable access to the identified content. The user who uploaded the content will be informed and provided with the necessary steps to file a counter-notification if they choose to do so.

Responding with a Counter-Notification

If you are the uploader of content that was removed and believe it was done in error or due to misidentification, you have the legal right to submit a counter-notification. This document must include:

• Identification of the content that was taken down, and its prior location on our website or services.
• Your full name, mailing address, telephone number, and email address.
• A statement under penalty of perjury that you believe the material was mistakenly removed or misidentified.
• A declaration that you consent to the jurisdiction of the Federal District Court in your local district, or if outside of the U.S., to any U.S. jurisdiction in which the service operates.
• A statement that you will accept service of process from the person who submitted the original takedown notice or their agent.
• Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If they do not file a legal action within 10 to 14 business days, we may restore the content that was previously removed or disabled.

Responsibility and Legal Notice

Both parties should understand that Section 512(f) of the DMCA holds individuals legally responsible for knowingly submitting false or misleading information in a takedown or counter-notice. Such behavior may result in legal consequences, including financial damages and attorney fees.
